Terms and Conditions of Use

In force since: 1 January 2026

1. Purpose and acceptance

These terms govern access to and use of bymangia.space, including all of its content, downloadable materials, tools, user accounts, restricted areas and forms (the "Site").

By browsing the Site you accept these terms. When you create an account you will be asked to accept them expressly, together with the Privacy Policy, and that acceptance is recorded. If you disagree, do not use the Site.

2. Operator

3. Nature of the content

The Site publishes articles, essays, downloadable materials, tools, audio and video content, and references to books and speaking engagements on technology strategy, IT management, digital transformation, business, science and academic commentary.

That content is professional opinion and commentary. It is not professional, legal, accounting, financial, cybersecurity or architectural advice for your organisation. It creates no advisor-client relationship. Any decision you take based on this material is yours, and you should validate it with advisors who know your context.

The views expressed are the author's own and do not represent the position of any employer, client, organisation or entity with which the author is or has been associated.

4. Access tiers

The Site offers three tiers:

  • Open content. Accessible without registration.
  • Free gated content. No cost, but limited to registered users with an active account.
  • Paid content and tools. Manuals, guides, standards, templates and tailor-made deliverables, priced at the point of purchase.

The scope of each tier may change, content may move between tiers, and materials may be discontinued, without giving rise to any claim, except in respect of what you have already acquired.

5. Provided as is, without warranties

All content, materials and tools on the Site, whether free or paid, are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.

In particular, and to the fullest extent permitted by applicable law, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency and freedom from error are disclaimed.

No warranty is given that any material will produce a particular result in your organisation, or that it fits your regulatory framework, your sector or your operating context. Assessing its suitability before use is your responsibility.

This clause does not exclude any warranty that consumer protection law in your country of residence establishes on a mandatory basis.

6. Intellectual property

All content on the Site belongs to Marcelo Mangiacavalli. This includes text, articles, illustrations, photographs, design, code, trade marks, logos, the "ByMangia" name, the books, and every manual, guide, standard, template and tool, both general release and tailor-made.

It is protected by Paraguay's Law No. 1328/98 on Copyright and Related Rights, by the applicable international treaties, and by equivalent legislation in each country.

The books "La Próxima Evolución Digital" and "The Next Digital Evolution" are sold through third-party platforms. Buying a copy grants a personal reading right, not a licence to reproduce, translate or distribute.

6.1. Licence of use

Delivery of any material, free or paid, grants a personal and internal use licence: non-exclusive, non-transferable, revocable and without the right to sublicense.

You may use the material inside your organisation, for your professional purposes, and adapt it internally.

You may not, under any circumstances:

  • Resell, license, rent, barter or commercialise the material, in its original or modified form.
  • Redistribute it publicly, publish it in open repositories, or share it outside your organisation.
  • Incorporate it into a product, service or deliverable that you sell to third parties.
  • Present it as your own work, or remove authorship attributions or watermarks.
  • Use it to train artificial intelligence models or to feed automated content generation systems.

Tailor-made materials follow this same rule, unless a signed contract between the parties expressly provides otherwise.

Breach allows immediate revocation of the licence and of your account, without refund, and the pursuit of any applicable civil and criminal remedies.

6.2. Quotation and fair use

You may quote the Site's public content for personal, educational, journalistic or professional purposes, provided the quotation is proportionate, you credit the source, and you link back to the Site.

Third-party trade marks appearing on the Site belong to their respective owners and are named for identification purposes only.

7. Prohibited use of the Site

You may not:

  • Extract data by automated means (scraping, mass crawling, harvesting) beyond what robots.txt allows.
  • Introduce malicious code, attempt unauthorised access, overload the infrastructure or circumvent security measures, including the access controls on gated content.
  • Share your credentials or let third parties use your account.
  • Impersonate anyone or use the Site for unlawful, defamatory or fraudulent purposes.

8. User accounts

  • You are responsible for the accuracy of the data you register and for keeping your credentials confidential.
  • Any activity carried out from your account is treated as yours.
  • Tell us immediately about any unauthorised use.
  • We may suspend or close an account that breaches these terms, with prior notice unless urgency or the law prevents it.
  • You may close your account at any time from your user panel or by writing to mangiam@bymangia.space.
  • If these terms or the Privacy Policy change materially, you will be asked to accept the new version on sign-in. If you decline, you keep access to open content but not to the restricted area.

9. Purchasing tools and services

9.1. Sales channels

Books and tools are sold through third-party platforms. Currently Amazon for international markets. Local payment gateways in Paraguay and Mercado Libre in Argentina may be enabled in future.

In those cases the platform acts as seller or intermediary, and the purchase, payment, delivery, warranty, exchange and refund conditions are the platform's own. Any claim connected to the transaction must be raised there.

9.2. Direct sale

If direct purchase is enabled on the Site in future, the applicable conditions (price, taxes, currency, payment methods, delivery times and refund policy) will be stated clearly before the order is confirmed and will form part of these terms.

For consumers in the European Union, where the item is digital content delivered immediately, Directive 2011/83/EU grants a 14-day right of withdrawal that is lost only if the consumer expressly consents to performance beginning and acknowledges that loss before download. That consent will be requested separately at checkout.

9.3. Professional services

Speaking engagements, advisory work and editorial collaborations are contracted outside the Site, in person or by electronic means, through a documented proposal and acceptance between the parties. Those agreements are governed by their own conditions, and by these terms only on a residual basis.

10. External links

The Site links to third-party platforms including Amazon, LinkedIn, Spotify, YouTube and X. Those sites are not controlled here, and no responsibility is accepted for their content, availability, privacy practices or any transaction you make there.

No affiliate programme is used and no commission is earned on the links published. If that changes, it will be disclosed expressly and visibly in this section.

11. Content you send us

When you write through the form or by email, you keep ownership of what you send and grant a limited licence to read, store and respond to it.

Do not send confidential or sensitive information, or anything covered by a non-disclosure agreement, through these channels. They are not secure for that purpose and no confidentiality obligation is assumed over unsolicited material.

Ideas or proposals sent unprompted create no right to compensation and no duty of secrecy.

12. Availability

The Site is intended to be continuously available but this is not guaranteed. It may be suspended, modified or discontinued, in whole or in part, for maintenance, technical reasons or by the operator's decision, without giving rise to any right to compensation.

No warranty is given that the content is free of errors or that it stays current. Technology moves fast and an article published two years ago may well be out of date.

13. Limitation of liability

To the fullest extent permitted by applicable law, no liability is accepted for indirect, incidental, consequential, special or punitive damages, or for loss of profit, loss of data, loss of opportunity or reputational harm, arising from use of or inability to use the Site, its content or the tools provided.

Where liability does arise, its total amount will not exceed what you paid for the material or service that caused it during the twelve months before the event.

Nothing in this clause excludes liability for wilful misconduct, gross negligence, personal injury, or any other liability that mandatory law does not allow to be limited, including consumer protection rules in your country of residence.

14. Indemnity

You agree to hold Marcelo Mangiacavalli harmless against third-party claims arising from your breach of these terms, from infringement of the intellectual property rights described in section 6, or from your unlawful use of the Site.

15. Changes

These terms may be updated. The version in force is always the one published at this address, with its date. Material changes will be flagged visibly and registered users will be asked to accept the new version. Continued use of the Site after publication means acceptance.

16. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Paraguay, and any dispute will be submitted to the ordinary courts of the city of Asunción, Paraguay, with express waiver of any other venue.

This clause does not deprive a consumer of the protection afforded by the mandatory rules of their country of habitual residence, nor of the right to sue in the courts of that country where the applicable law allows it. In particular, the rights granted by Paraguay's Law 1334/98, Regulation (EU) 1215/2012, Argentina's Law 24.240 and Chile's Law 19.496 are respected.

17. Miscellaneous

If any clause is held void or unenforceable, the rest remains in full force. Tolerating a breach does not waive the right to require future compliance. These terms, together with the Privacy Policy, form the entire agreement between you and the operator regarding use of the Site.
